Claudy Gassant, the juge d’instruction (investigating judge) in the Jean Dominique case, describes the structure and function of the justice system and the power and limitations of a juge d’instruction. There is no such thing as a “ti jij” -- a juge d’instruction has a different role but is not less important than a juge de paix or a judge on the Cour de Cassation. He responds to the letter from the l'Ordre des Avocats du Barreau de Port-au-Prince, accusing Gassant of misconduct. He discusses the investigation into the Jean Dominique assassination, and the danger he faces as the judge in that case. Gassant also discusses immunity and the independence of the judiciary (the Minister of Justice cannot dismiss a judge from a case) and the question of parliamentary immunity.
Claudy Gassant, le juge d’instruction dans l'affaire Jean Dominique, explique la structure et la fonction du système judiciaire et le pouvoir et les limitations d’un juge d’instruction. Un « ti ji » n’existe pas ; un juge d’instruction a un rôle différent mais d'égale importance qu'un juge de paix ou qu'un juge de la Cour de Cassation. Il répond à une lettre de l'Ordre des Avocats du Barreau de Port-au-Prince qui l’accuse de faute professionnelle. Il parle de l'enquête sur l'assassinat de Jean Dominique et du danger auquel il fait personnellement face en tant que juge dans cette affaire. Gassant aborde aussi les questions de l’immunité, de l'indépendance des magistrats (le ministre de la Justice ne peut pas écarter un juge d’un dossier) et de l'immunité parlementaire.
