Attorneys and justice experts discuss the "sickness" and dysfunction of the Haitian justice system. They locate this sickness in Haiti's history, as the nation emerged from slavery in 1804 only to fall into a feudal system based on exclusion. They try to explain in detail the structure of the justice system and the different roles and functions (juge de paix, commissaire de gouvernement, and so on). They discuss at length the issue of impunity, including the Jean Dominique assassination and other cases. Why does law not correspond to the reality of society? Impunity also has a social class aspect, in which poor and powerless people can be killed with no repercussions -- for example, chefs de section killing peasants with impunity. The years of the Duvalier dictatorship deformed the meaning and apparatus of justice in Haiti. After the Duvalier regime fell, justice was the first demand of the people, but exclusion and marginalization persist. There have been some signs of progress -- for example, the Raboteau trial -- but many other human rights violations and injustices of the coup years have gone unaddressed. They discuss corruption in the justice system, the question of judicial reform, prison reform, and the politicization of the justice system.
Des avocats et des experts judiciaires expliquent la « maladie » et le dysfonctionnement du système judiciaire haïtien. Ils situent la source de cette gangrène dans l’histoire haïtienne, précisément quand le pays sortit de l’esclavage en 1804 pour mieux tomber dans le piège d’un système féodal basé sur l’exclusion. Ils essaient d’expliquer en détails la structure du système judiciaire et les différents rôles et fonctions (juge de paix, commissaire du gouvernement et ainsi de suite). Ils abordent le problème de l’impunité, y compris dans l’assassinat de Jean Dominique et dans d’autres affaires. Pourquoi est-ce que la loi ne correspond pas à la réalité de la société ? L’impunité dépend notamment de la classe sociale : les pauvres et les faibles peuvent être tués sans conséquence – par exemple les chefs de sections pouvaient tuer les paysans sans être inquiétés. Les années de dictature ont déformé le sens du mot justice et l'appareil judiciaire haïtien. Après la chute de Duvalier, la justice était la première exigence du peuple, mais l’exclusion et la marginalisation continuèrent. Il y a certains signes de progrès comme le procès de Raboteau, mais de nombreuses injustices et violations des droits de l'homme pendant les années du coup ont été ignorées. Ils parlent aussi de la corruption dans le système juridique, de la réforme judiciaire, de la réforme pénitentiaire et de la politisation du système judiciaire.
